While the saga of Judge Neil Gorsuch’s confirmation drags on, Senate Democrats know they are facing a dilemma of their own making. They should spare the country further drama and just get on with the process of filling Justice Antonin Scalia’s seat on the U.S. Supreme Court.
Although Judge Gorsuch said during his confirmation hearing that he would have walked out of the room if President Trump asked him to overturn Roe v. Wade, and even though he has never ruled specifically on abortion, he is still a good choice for the pro-life movement, and anyone who cares about the rights of the unborn.
“[A]ll human beings are intrinsically valuable and the intentional taking of human life by private persons is always wrong,” the judge wrote in his book on assisted suicide. But his words obviously apply to abortion as well. And in that case, his words are in direct conflict with some, if not most, of the Supreme Court’s abortion rulings, including Roe v. Wade.
Judge Gorsuch also wrote in his 2006 book The Future of Assisted Suicide and Euthanasia, “But even if a certain degree of arbitrariness or uncertainty is tolerable and perhaps even inherent in many policy decisions, it is simply not acceptable when we are deciding who is and is not treated as fully human.”
Is there any doubt but that the Roe court did precisely that? The Roe v. Wade decision and all subsequent Supreme Court abortion rulings have turned on the arbitrary pronouncement that babies in the womb are not “persons.” Sixty million aborted children later, they’re still treated as not fully human.
We understand why the Democrats and their donors at Planned Parenthood would want to block Judge Gorsuch’s path to the Supreme Court bench, and it has nothing to do with Republicans’ refusal to grant a hearing to President Obama’s pick, Judge Merrick Garland. It’s because they know as well as pro-lifers do that 1973’s Roe v. Wade decision was an obscene example of judicial overreach and that, given the right case, Judge Gorsuch would vote in favor of protecting babies in the womb.
